Court voids impeachment of Achuba as Kogi DG

A High Court sitting in Lokoja has declared the impeachment of a former Kogi State Deputy Governor, Simon Achuba, by the House of Assembly as illegal, null and void.

Justice John Olorunfemi said Achuba’s impeachment is a violation of the constitution and the subsequent nomination of Edward Onoja as deputy governor did not follow due process

Achuba was in October 2019 impeached by the Assembly.

The judge described the action of the Kogi State House of Assembly as a constitutional coup, hatched and executed in a democracy, adding that the action is contrary to Section 188 subsection 8.

He said the onus to produce the remaining volumes of the report purported to have indicted the former deputy governor rests on the defendants, but they failed to do, pointing out that the 29th defendant did not file a counter notice.

The court held that Achuba’s impeachment violated the constitution as the report submitted to the Assembly did not indict him.

The former deputy governor fell out with Governor Yahaya Bello shortly after they were sworn into office.
