The Court of Appeal sitting in Lagos, has nullified the victory of the Labour Party candidate, Darlington Nwokocha as the senator representing Abia Central Senatorial District in the February 25 election.
The court declared former National Organizing Secretary of the People’s Democratic Party, PDP, Col. Austin Akobundu as the rightful winner of the election.
This was made known in a post on the PDP verified X handle, formally twitter, on Saturday evening.
The Independent National Electoral Commission had declared Nwokocha as the winner of the election with a total of 92,116 votes while Akobundu came second with 41,477 votes.
Unhappy with the outcome, Akobundu petitioned the Election Petition Tribunal to have Nwokocha’s election overturned. But in September, the tribunal dismissed his petition.
The PDP candidate went to the appellate court, unfazed by the decision.
He was, nevertheless, proclaimed the victor of the Abia central senatorial district election by the Apex Court.
Akobundu referred to his triumph at the Appeal Court as a people’s victory.
In a statement, the PDP said Akobundu and Osita Ngwu of Enugu west “are the two senators of the PDP extractions from the South-east region at the National Assembly.
